How do you recover from being accused of sexual harassment?
Q. I have a bad habit of staring at people (male, female doesn't matter). I think that someone pressed sexual harassment or harassment charges with HR. Is there any way to recover professionally from this?

A. It won't likely go to court. But if it's a frequent habit of yours, you will probably get a warning from your manager that your staring is creating a hostile workplace environment. The fact is, staring *is* considered rude and aggressive behavior by many people. In some cultures, it can even mean that you're looking for a fight and can get you punched out (try moving to a Latino neighborhood, if you don't believe me).

How can you file harassment charges against someone and not have proof?
Q. My ex-mother-in-law recently was taken to jail, her son's current wife filed harassment charges against her. When my ex-mother-in-law received the affidavit from her attorney, there were such false allegations. Talking about stealing their dogs, when the pound & the police were the ones that took the dogs from them due to animal cruelty, there is even a police report on that. Another allegation was that she was calling many times. No one even knows their number. I just want to know if by the court date, will the plaintiff have to bring proof with her of these allegations? It just seems like you can file harassment charges against anyone.

A. The wife will need to produce some type of evidence. She can make the claim, but without a way to prove it, she's blowing smoke. If this was the case, anyone could claim anything against anyone.

A. I would really like to help you- but I can tell you that you will lose this case. Why? Because the best defense against a defamation of character case is "absolute truth", and photos and videos do not lie. So taking this person to court for defamation of character won't work unless they are telling a LIE about you or spreading rumors in such a way as to expose you to hatred, ridicule or contempt. You also can sue if the defamation harms you in your occupation- but you have to PROVE that they lied about you to the public, AND that it impacted your life in a negative way. A. Most of the advice on this question shows a lack of common sense and knowledge of a business workplace. The best thing for the guy to do is to be a man and tell the woman nicely that her actions aren't welcome. If that does't work, then the situation could be harassment and he needs to talk with his supervisor or HR. The short term tension resolves a long-term problem of team morale, his long-term discomfort, and may prevent this from happening to someone else. Anyone who has worked in business long enough has seen one person destroy the whole morale of the office, that's what this woman is doing, and he needs to stop it.

How do I download voicemail messages as proof of harassment?
Q. My sister's ex-boyfriend has been calling her constantly on her cell phone and my parents' house phone as well as coming by our parents' house unannounced to harass her. My sister has kept all of the voicemail messages he left on her phone but her mailbox is almost full. Does anyone know if there is a way to download her messages to the computer so she can burn them on a CD or something so she can keep her voicemail from getting full. One of the most common (and frustrating) attitudes I find is that (heterosexual) sex is somehow owned by women and borrowed by men, rather than something two people do together, e.g. the expression "put out" -- I've never heard that phrase applied to a man. This attitude, especially in concert with the tendency of some men to take a woman's consent and/or interest for granted, seems likely to be among the more damaging ones. And, of course, widespread media objectification of women seems like it would lead a lot of people to forget that women don't exist to fulfill other people's sexual desires.

A. I would get the make, model, color and plate number and then call 911, if you don't do something to stop these type of people, they may very well injure or kill someone. Road Ragers cause serious injury and property damage that are passed on through increased insurance premiums. I care a post-it pad in my vehicle along with a pen in the visor that I use for conditions such as these. We pay taxes to use these roads the same as these other people. The police will thank you for helping them, the same as a person calls to report a drunk or drug impaired driver the same is true of these road ragaholics.

A. No, it depends on the action and the person complaining. Some people are more sensitive than others. For instance, if a guy tells a dirty joke and it's funny, it's no big deal. If it's not funny, I'll ignore him. If he persists in telling me raunchy jokes even though I've repeatedly told him to stop, then it becomes harassment. Looks don't matter; jerks are jerks.
