A. Whether an act is a crime or not would depend on the laws enforced in your place. If an act is not made illegal in your place then its not punishable.

What is harassment and when does it become a crime?
Q. At what point does harassment become a crime? Is it a crime to follow someone home but not stop? It it a crime to call someone a few times wanting some information? When is it truly a crime?
Asked by linniemouse - Wed Apr 1 15:58:11 2009 - - 1 Answers - 0 Comments

A. tell them to stop, the moment they continue it is a crime. but you must first tell them to stop. following you home is stalking call the police and report it at once. that way you have an official police report to back you up. You may need to file a restraining order. once that order is violated then the police have a reason to do something about it. Good luck. If you are in doubt then call the local police department and explain the situation to them and ask for guidance as to how to proceed.

A. probably in the 90s. Sexual harassment is pretty easy to get away with, and if it's stopped it's usually a verbal agreement before authorities are contacted.

How to exclude Violent-Based and Harassment Campus Discipline offenders from leadership roles on campus?
Q. My roommate was sexually harassed by a male student and his roommate. The male student was already expelled and was warned to stay off campus and cease contact. His roommate was involved indirectly in knowing what was going on but not stopping it and not preventing further harm to my roommate. The roommate faced alternative action in the judicial system to have some mediation. So now my roommate applies to be a student congress rep, thinking it will help her heal and feel better. Then after announcing her consideration, the male roommate alternatively disciplined all of a sudden applies. She then withdraws her candidacy for the position appointment. A. As your administrator has told you, discipline records are confidential STILL. They cannot be revealed without consent of the person. You could require all candidates to sign a consent form allowing the Congress to investigate disciplinary records. Most school governments have this kind of form for grade verification, which is also confidential.

How bad does harassment/ slander need to be in order to obtain a subpoena for the ISP?
Q. Just how bad or excessive does harassment need to be before someone can hire an attorney and gain a subpoena from an internet service provider?
Asked by Little Miss Sass - Fri Sep 5 19:56:58 2008 - - 2 Answers - 0 Comments

A. First you sue. Then you survive dismissal. Then you schedule a deposition. Then you send the subpoena and the service provider bring the records to the deposition. A subpoena can only be used in aid of an existing lawsuit, not to held decide if you have a lawsuit. So, it has to be bad enough to state a claim in court, sufficient to avoid dismissal.

A. Speak to your manager. I just think it is sooo rude for anyone to be yelled at, especially in public. Do not let this one go without saying anything to your manager, otherwise your supervisor will keep abusing you in public. Good Luck. Hate bullies!

What can you do about internet harassment and defamation?
Q. What can you really do about Internet harassment and defamation? If you have personal content such as photos, videos, or text that is being posted to a web site intended to make fun of you and including harassing and defamatory content, what can you do to get it removed from the site? Doing a web search to find a lawyer only yields sexual harassment lawyers and nothing else. What can be done to get your images and likeness removed from a web site?

A. I would really like to help you- but I can tell you that you will lose this case. Why? Because the best defense against a defamation of character case is "absolute truth", and photos and videos do not lie. So taking this person to court for defamation of character won't work unless they are telling a LIE about you or spreading rumors in such a way as to expose you to hatred, ridicule or contempt. You also can sue if the defamation harms you in your occupation- but you have to PROVE that they lied about you to the public, AND that it impacted your life in a negative way. Defamation cases for that reason are hard to win. What you do have is a violation of your rights to privacy. Collect all the evidence you can. Save the webpages for… [cont.]

Why would being called siamese twin at work be considered harassment?
Q. My husband and I work together. We go to lunch and breaks together like anyone else and when we have vacation time we take off together from our job. But any time our department manager and I speak about taking time off or taking our breaks or lunch she calls us siamese twins. I have told her to not do that and she continues to call us out of our names for fun. Is this considered harassment?
Asked by mrs. C - Sun Jun 6 11:31:50 2010 - - 3 Answers - 0 Comments

A. heck no, the manager is probably just goofing around. she probably says it because of the fact that you do everything together and are "joined at the hip" as the saying goes. i dont think she means any harm of it. but she SHOULD respect you if you have told her to stop. but its not harassment

Is it sexual harassment if a guy ask a girl out at work?
Q. What if there is a co-worker you like and you respectfully ask her out? Is that Sexual Harassment? I'm talking about if work is the only time you see her, and the only chance to ask her out is at work, would asking her out still be considered sexual harassment? This didn't happen to me, I'm just curious.
Asked by conservativeh8er - Tue Jun 9 16:49:36 2009 - - 3 Answers - 1 Comments

A. It depends- Does she find you attractive? If not, it's likely to be sexual harassment! Somewhat more serious answer- It's just not a good idea to take the chance. Is it an 'unwelcome' advance? It's probably better not to find out after the fact. HR tends to be VERY responsive to these sorts of concerns in order to avoid potential lawsuits. If you are truly interested, find another chance. Or, better yet, don't cross that line at work.

How do men handle sexual harassment in the workplace?
Q. A male co-worker of mine gets visibly uncomfortable when a female member of staff overtly flirts with him. He seems so afraid of her that he never wants to be alone with her. How do men handle situations like this in the workplace? Do you file a sexual harassment report with HR?
Asked by Liza - Thu May 11 21:01:28 2006 - - 14 Answers - 2 Comments

A. Most of the advice on this question shows a lack of common sense and knowledge of a business workplace. The best thing for the guy to do is to be a man and tell the woman nicely that her actions aren't welcome. If that does't work, then the situation could be harassment and he needs to talk with his supervisor or HR. The short term tension resolves a long-term problem of team morale, his long-term discomfort, and may prevent this from happening to someone else. Anyone who has worked in business long enough has seen one person destroy the whole morale of the office, that's what this woman is doing, and he needs to stop it.

What are the penalties for online harassment?
Q. If a member of a website would happen to send me a message basically saying something like, "I know who you are and I'm coming to get you" is that considered harassment? And what are the legal penalties that can occur?
Asked by Angie - Sun Aug 2 19:44:51 2009 - - 8 Answers - 0 Comments

A. That is indeed considered harassment, and should be taken seriously. At least one member of this community has responded to such threats by reporting them to the local authorities, who in turn pass the threat on to the FBI. Fines and possible imprisonment may result, depending on where the case is prosecuted. Jamal, The FBI does get involved if the crime is committed across state lines, or internationally. The local police are the first point of contact, and these routinely get bumped to the federal level if they're determined to be a serious enough threat.

CA Law. How many times can you call a person in a row before it is considered harassment?
Q. If you are calling someone and leaving annoying messages (not threats) on the machine, is that considered harassment? When does it become harassment. Could it be considered terrorism? Just wondering.
Asked by toisnlks - Sat Nov 28 11:22:56 2009 - - 3 Answers - 0 Comments

A. 653m of the California Penal Code. Any person who makes annoying and/or threatening phone calls is guilty of a misdemeanor. The code section is about annoying or threatening. It does not say how many calls constitute annoying. It is the actions that define the crime. Most likely three or more calls would fit within the code section. If the calls are recorded or left on an answering machine, that would be excellent evidence in a court of law. There is a separate code section for terrorist threat that is a felony. The line between threatening phone call and terrorist threat can be very fine. X-spouses who have a predatory nature or history are often prosecuted for this felony. A felony conviction can put the caller in state prison… [cont.]

Q. I mean, if your the victim of sexual harassment, why are you suing the corporation? How were they to know that the employee they hired was going to sexually harass you in the future?

A. The corporation can only get sued if the person that was harassed complained about it and nothing was done to prevent it from happening again. If the employer fails to take care of the problem, the harasser and the employer can get sued by the victim.

How much can they get for a sexual harassment law suit?
Q. A friend of mine worked for an employer who is now being sued for sexual harassment by EEOC. She quit her job because of being sexually harassed even after telling her boss. She was just wondering how much they could possibly get for her since quitting her job was not in her plans and cost her a lot. Any ideas please let me know. I guess the point of this is if she is going to only get a couple hundred dollars and everyone knows that she reported the harassment then it would not be worth it but if she will really get enough to make it worth it fine.

A. in 2009 the EEOC received almost 13000 sexual harassment complaints of those almost 12000 were resolved by the EEOC. 1400 of those resulted with a monetary settlement and NO continuation of employment. another 1400 ended with a monetary settlement and the claimant returned to the same job. the EEOC won $51,500,000.00 in settlements in 2009 which was an average of $18,400.00 per claim. of course averages are in reality useless because each case is different, some of these resulted in just back pay of a few cents an hour while others involved large sums of back pay and future earning potential. there is really no way to even guess how much this person may get if anything without knowing what the claim was for. a small raise or a large… [cont.]
